A woman and her five children will have to find a new place to live after she lost a battle with her siblings over their deceased father’s house.

Lorna Phillipps has been living in the Parakai property rent-free for more than two years. But her siblings wanted to sell it.

In a hearing at the Auckland High Court, Justice Rebecca Edwards said Phillipps, who was a beneficiary and had six children, five of whom were living with her, had moved into the property in 2016.

She did not seek her siblings’ consent but they did not object at the time.
